Must disclose to Fleetsmarts if you are submitting a load for funding and there is any dispute with the broker that could prevent payment (claims, damages, count disputes, theft, late fees, or other service failures).

Must alert Fleetsmarts if any dispute arises on a load with a broker that might affect Fleetsmarts' ability to collect.

Must abide by all contractual commitments.

It is good practice to keep your concentration level with all customers under 30%.

It is good practice when doing business with Total Quality Logistics (TQL) to wait until loads are paid prior to doing more loads.

Fuel at least 90% of the time at our network locations.

Must pay for products and services at the pre-determined time.

If you receive funds from a broker for a load that Fleetsmarts funded, you must not cash it (if it is a check) and must notify Fleetsmarts within 48 hours.

This is not a comprehensive list. There are limitless ways that carriers can act unethically. Any unethical conduct may be considered an Ethical Violation and subject to the penalties described herein.
Failure to do so may result in the following: a fine of up to $5,000 per occurrence, an increased factoring rate of 3% or more for 90 days or more for the first offense, permanent increases for additional offenses, and possible termination of the Factoring Agreement.
